b. The Website is owned and operated by Megane Foucher and Valentin Bausire. Please read these terms and conditions (the 'Terms') carefully. By using, browsing and/or reading the Website, this signifies that you have read, understood and agree to be bound by the Terms. If you do not agree with the Terms, you must cease usage of the Website, or any of Services, immediately.
c. FAUVVE reserves the right to review and change any of the Terms by updating this page at its sole discretion. When updates the Terms, it will use reasonable endeavours to provide you with notice of updates to the Terms. Any changes to the Terms take immediate effect from the date of their publication.
2. Acceptance of the Terms
a. You accept the Terms by remaining on the Website. You may also accept the Terms by clicking to accept or agree to the Terms where this option is made available to you by in the user interface.
3. Access and use of the website
a. You must only use the Website in accordance with these Terms and any applicable law.
b. You must not (or attempt) to:
- interfere or disrupt the Website or the servers or networks that host the Website or any security-related or other features of the Website; use any data gathering and extraction tools on the Website; or
- link to any part of the Website in a way that damages or takes advantage of FAUVVE reputation.
5. Copyright and Intellectual Property
a. The Website, the Services and all of the related products of are subject to copyright. Unless otherwise indicated, all rights (including copyright) in the Services and compilation of the Website (including but not limited to text, graphics, logos, photography, video images, Website code) or the Services are owned or controlled for these purposes, and are reserved by FAUVVE
b. All photographs taken by FAUVVE are copyright protected. FAUVVE will allow reproduction and publishing for personal use (eg. wall hangings at home, instagram, facebook, blogs), but any sale or publication for profit without FAUVVE's express written permission is a violation of federal copyright law.
6. Model Release
a. Client hereby agrees that FAUVVE may reproduce, publish, exhibit, and otherwise use images for instructional or marketing purposes without payment of any additional fee.
7. Photographer's responsibilities
a. FAUVVE (“Photographer”) hereby agrees to perform photographic services for Client at the Event specified in agreed contract in a professional, workman like manner according to the prevailing standards in the industry (“Services”). Photographer will make every effort to obtain, but cannot guarantee delivery of, any specific images requested by client because of Photographer’s lack of control over the Event, its participants, weather, and any rules or restrictions of the venue or official conducting the Event.
b. If Photographer is exposed to unsafe conditions, or objectionable or illegal acts at the Event, Photographer reserves the right to take reasonable action to remedy such a situation, including but not limited to leaving the Event. In such event, Photographer shall not be obligated to refund any of the fees paid by Client because of such action.
8. Event Changes
a. FAUVVE must be notified immediately of any changes in schedule or location.
9. Deposit payments
a. A non-refundable retainer (that shall be applied toward the total fee for the Services) at which time FAUVVE commits to being available to Client on that date (subject to non-payment, reasonable emergencies and force majeure events). In the event that Client fails to remit payment as specified, FAUVVE shall have the right to immediately terminate Agreement with no further obligation to refund money (including the aforementioned retainer), to attend the Event or to supply images.
a. Upon acceptance of these terms and payment of the retainer, FAUVVE shall commit to attending the Event on the specified date, and shall make no other reservations for that date. If Client cancels the Event entirely, then FAUVVE shall not be required to repay any of the payments made by Client. If cancellation takes place within two months of the Event, the Client will attract a cancellation fee of 50% of the remaining invoice. If cancellation takes place within a month, the Client will attract a cancellation fee of 75% of the remaining invoice.

Changes may occur in circumstances at any time which may affect the accuracy or completeness of the information, so while FAUVVE has taken all reasonable care in producing this Website, it accepts no responsibility for any loss, expense or liability that you may incur from using or relying on the contents in this Website. Any legal rights and obligations which FAUVVE and you may have will be contained in the terms and conditions of contractual information issued to you.
